PUBLIC NOTICE

Pursuant to the “Surface Mining Conservation and Reclamation Act” and the “Clean Streams Law”, notice is hereby given that Black Cat Coal, LLC, doing at 446 Wm. Cemetery Road, Curwensville, PA 16833 is making application to PA Department of Environmental Protection for a permit to conduct surface coal mining activities on the Mays Operation.

The 31.0-acre operation is located in Pike Township, Clearfield County is situated approximately 2,500 feet north of the intersection of State Road S.R.2022 (a.k.a. Little Clearfield Creek Road) and Township Road T-766 (a.k.a. Mays Road) on the properties of Linda L. London and others. The area is located on the Curwensville and Glen Richey U.S. Geologic Survey 7½ Minute quadrangle map 9.2 inches north and 0.1 inches west from the bottom right hand corner of the printed area of the Curwensville quadrangle. The proposed permit area is located within the watershed of unnamed tributaries to Little Clearfield Creek which is designated as High Quality-Cold Water Fishes.

The Operator is also requesting permission to conduct mining activities within 100’ of Unnamed Tributary. The encroachment begins at the point where the present road intercepts Mays Road and will extend up-gradient for a distance of approximately 325 feet.

A copy of the application is available for public inspection at the Clearfield County Conservation District Office, 6395 Clearfield-Woodland Highway, Suite 2, Clearfield, PA 16830 and the D.E.P. offices in Philipsburg, PA. Written comments, objections and requests for public hearing or informal conference on the above referenced bond release may be submitted to the Department of Environmental Protection, Moshannon District Office, 186 Enterprise Drive, Philipsburg, PA 16866 within 30 days following the last publication of this notice and must include the person’s name, address, telephone number and a brief statement as to the nature of the objection(s).
