Judge Ammerman presides at plea and sentencing court session

Clearfield County President Judge Fredric J. Ammerman presided over a session of plea and sentencing court Sept. 10-11.
• James M. Barto, 52, state correctional institution, was ordered to serve three to six months in Western Diagnostic Classification Center, Pittsburgh, on a charge of driving under the influence to be served consecutive and aggregated to all charges currently being served. He received a $500 fine, is to refrain from the use and possession of alcohol and controlled substances, complete a full drug and alcohol evaluation, and immediately surrender his driver's license. On summary offenses of driving on roadways laned for traffic and safe speed, he received a $35 fine on each charge. On a summary offense of drivers required to be licensed, he received a $210 fine and on a summary offense of restraint systems, he received a $20 fine.
• John E. McMahon, 68, 505 Sheridan Drive, Clearfield, was ordered to serve 90 days to one year in Clearfield County Jail in addition to two years' consecutive probation on a charge of DUI. He received a $1,500 fine, is to refrain from the use and possession of alcohol and controlled substances, complete the DUI School and a full drug and alcohol assessment, and immediately surrender his driver's license. On a summary offense of driving on roadways laned for traffic, he received a $35 fine and on a summary offense of restraint systems, he received a $20 fine.
• Matthew J. Sones, 29, 607 Hannah St., Clearfield, was ordered to serve 15 days to one year in CCJ on a charge of possession of a controlled substance. He received a $200 fine, is to refrain from the use and possession of alcohol and controlled substances, complete drug and alcohol counseling and complete the Clearfield/Jefferson Drug Awareness Program.
• Robert N. Scott Jr., 20, 751 U.S. Route 119, Punxsutawney, was placed on one-year probation on a charge of possession of drug paraphernalia. He received a $200 fine, is to refrain from the use and possession of alcohol and controlled substances, not enter bars or places that serve alcohol, and complete drug and alcohol counseling.
• Richard A. Breeden, 20, Coalport, was ordered to serve 60 days to one year in addition to two years' consecutive probation on three separate cases of burglary. He was fined $100 on each case, is to refrain from the use and possession of alcohol and controlled substances, complete counseling as recommended by his probation officer, not enter Glendale Sportsmen's Club, Carquest Auto in Houtzdale, Kart Auto, pay restitution and submit to DNA testing at a cost of $250.
• John C. Kimberling, 30, 115 W. Weber Ave., DuBois, was ordered to serve 60 days in CCJ on a summary offense of driving under suspension (DUI-related), and received a $500 fine. On a charge of accidents involving death or personal injury, he received a $100 fine and was placed on two years' consecutive probation. He is to refrain from the use of alcohol and controlled substances, not enter bars or places that serve alcohol, attend counseling as recommended by his probation officer, have no contact with the victim or family and pay restitution.
• Samantha L. DeJesus, 22, 1967 Alfred Blvd., Navarre, Fla., was ordered to serve 60 days to one year in CCJ in addition to two years' consecutive probation on two separate cases of theft from motor vehicle. She was fined $225, is to refrain from the use and possession of alcohol and controlled substances, attend counseling as recommended by her probation officer and pay restitution.
• Jessica L. Cartwright, 21, 1402 Washington Ave., Hyde, was ordered to serve 10 days to one year in CCJ on a charge of simple assault. She received a $100 fine, is to refrain from the use and possession of alcohol and controlled substances, not enter bars or places that serve alcohol, complete anger management counseling and complete 40 hours of community
• Gwendolyn M. Johnson, 41, 18½ E. Weber Ave., DuBois, was ordered to serve 10 days to one year in CCJ in addition to one-year consecutive probation on a charge of DUI. She received a $500 fine, is to refrain from the use and possession of alcohol and controlled substances, not enter bars or places that serve alcohol, complete a full drug and alcohol assessment, complete 100 hours of community service, immediately surrender her driver's license and comply with ACT 63, which suspends a person's driver's license for an additional year. The suspension may be waived if she installs an approved ignition interlock system on each motor vehicle she owns.
• Jason T. Colbert, 40, Clearfield, was ordered to serve 10-90 days in CCJ on a summary offense of harassment. He received a $50 fine, is to refrain from the use and possession of alcohol and controlled substances, not enter bars or places that serve alcohol, have no contact with the victim or family and attend counseling as recommended by his probation officer. On a summary offense of harassment, he received a $50 fine and was placed on 90 days' consecutive probation.
• Edward W. Creek, 44, 139 Bancoft Ave., West Seneca, N.Y., was ordered to serve one to two years in CCJ in addition to 18 months' consecutive probation on a charge of DUI. He received a $2,500 fine, is to refrain from the use and possession of alcohol and controlled substances, not enter bars or places that serve alcohol, complete a full drug and alcohol assessment, immediately surrender his driver's license and comply with ACT 63. On a summary offense of careless driving, he received a $35 fine.
• Harry M. Hall, 18, 318 Thompson St., Curwensville, was placed on two years' probation on a charge of theft by unlawful taking. He received a $100 fine, is to attend counseling as recommended by his probation officer, and have no contact with the victim or family. On a summary offense of defiant trespass, he received a $50 fine.
• Cassandra L. Hook, 22, 338 N. Locust Lane, Flinton, was placed on two years' probation on three counts of theft by unlawful taking. She was fined $100 on each count, is to refrain from the use and possession of alcohol and controlled substances, attend counseling as recommended by her probation officer, not enter Leyo's in Coalport and pay restitution.
• Matthew C. Knepp, 33, 103 New Liberty Road, Philipsburg, was ordered to serve 90 days to one year in CCJ in addition to two years' consecutive probation on charges of theft by unlawful taking and retail theft. He received a $250 fine, is to refrain from the use of controlled substances, not enter Auto Zone, Philipsburg, complete the retail theft program, attend counseling as recommended by his probation officer and pay restitution.
• Parsha L. Knepp, 25, 210 Turnpike Ave., Clearfield, was ordered to serve 30 days to one year in CCJ in addition to two years' consecutive probation on a charge of retail theft. She received a $100 fine, is to refrain from the use and possession of alcohol and controlled substances, complete the retail theft program, not enter Sheetz in Clearfield, pay restitution and not own or possess narcotics or prescriptions for narcotics without first receiving written permission of her probation officer.
• Charles J. Lese, 52, 221 Nichols St., Clearfield, was ordered to serve 48 hours to six months in CCJ on a charge of DUI. He received a $1,000 fine, is to refrain from the use and possession of alcohol and controlled substances, not enter bars or places that serve alcohol, complete the DUI School and a full drug and alcohol assessment, and immediately surrender his driver's license. On a summary offense of driver's required to be licensed, he received a $210 fine and on a summary offense of careless driving, he received a $35 fine. On a summary offense of restraint systems, he received a $20 fine.
• Johnalee Smeal, 28, 15 Bowtie Road, Morrisdale, was placed on one-year probation on a charge of possession of drug paraphernalia. He received a $200 fine, is to refrain from the use and possession of alcohol and controlled substances, not enter bars or places that serve alcohol, and complete a full drug and alcohol assessment.
• Joshua L. Mostoller, 23, Irvona, was placed on two years' probation on a charge of receiving stolen property. He received a $200 fine, is to refrain from the use and possession of alcohol and controlled substances, not enter bars or places that serve alcohol, have no contact with the victim or family and not enter his property, attend counseling as recommended by his probation officer, continue to cooperate with law enforcement in prosecution of the co-defendant and pay restitution.
• Chad A. Wilson, 23, 720 Good St., Houtzdale, was ordered to serve six months to one year in CCJ in addition to two years' consecutive probation on two counts of burglary and criminal mischief. He was fined $325, is to refrain from the use and possession of alcohol and controlled substances, attend counseling as recommended by his probation officer, not enter Moshannon Construction Equipment and submit to DNA testing at a cost of $250.
On a second case of theft by unlawful taking, Wilson was ordered to serve a concurrent sentence of six months to one year in CCJ and an additional two years' probation. He is not to enter Northern Sun Coal Co. or its mining sites.
• Joseph S. Wilson, 42, 315 E. Locust St., Clearfield, was ordered to serve 12 months to five years in the Western Diagnostic Classification Center on a charge of theft by unlawful taking. He received a $1 fine, is to refrain from the use and possession of alcohol and controlled substances, have no contact with the victim or family, complete counseling as recommended by his probation officer, pay restitution and submit to DNA testing at a cost of $250.
• Amanda C. Donley, 22, 116 W. Long Ave., DuBois, was placed on one-year probation on a charge of possession of a controlled substance. She received a $200 fine, is to refrain from the use and possession of alcohol and controlled substances, not enter bars or places that serve alcohol, attend drug and alcohol counseling and have no contact with the co-defendant.
• Jacob J. Estright, 20, 1035 Apt. A, Hill St., Philipsburg, was placed on two years' probation on charges of fleeing or attempting to elude police and recklessly endangering another person. He was fined $150, is to refrain from the use and possession of alcohol and controlled substances, not enter bars or places that serve alcohol and attend counseling as recommended by his probation officer. On summary offenses of operation of ATV in careless manner, operation on streets and highways and stop signs, he received a $35 fine on each charge. On a summary offense of driving under suspension, he received a $210 fine.
• Cody C. Graham, 19, 1769 Shadybrook Drive, Clearfield, was placed on two years' probation on a charge of theft by unlawful taking. He received a $200 fine, is to refrain from the use and possession of alcohol and controlled substances, have no contact with the victim or family and not enter the property of the victim. On a summary offense of defiant trespass, he received a $50 fine.
• Nathan L. Shaw, 24, 1194 Cooper Ave., Grassflat, was ordered to serve 30 days to six months in CCJ on a charge of DUI. He received a $750 fine, is to refrain from the use and possession of alcohol and controlled substances, not enter bars or places that serve alcohol, complete the DUI School and a full drug and alcohol assessment, immediately surrender his driver's license and comply with ACT 63. On a summary offense of driving on right side of roadway, he received a $35 fine.
• Robert A. Fennell, 41, SCI, was ordered to serve six to 12 months in the SCI on a charge of aggravated assault to be served consecutive and aggregated to all charges presently being served.
• Dwayne J. Hill, 42, SCI, was ordered to serve six months to two years in the SCI on a charge of simple assault to be served concurrent to all charges presently being served.
• Eric M. McKenzie, 25, SCI, was ordered to serve 12 months to two years in the Western Diagnostic Classification Center on a charge of aggravated assault by prisoner. He received a $1 fine, is to refrain from the use and possession of alcohol and controlled substances, attend counseling as recommended by his probation officer, have no contact with the victim or family and submit to DNA testing at a cost of $250.
• Nicholas J. Everett, 27, 416 W. Spruce St., DuBois, was ordered to serve six months to three years in the Western Diagnostic Classification Center on charges of criminal use of a communication facility, possession with intent to deliver a controlled substance, specifically marijuana, and possession of drug paraphernalia. He was fined $1 on each charge, is to refrain from the use and possession of alcohol and controlled substances, attend counseling as recommended by his probation officer and submit to DNA testing at a cost of $250.
On a second case of simple assault, Everett was fined $1 and placed on two years' concurrent probation. He is to complete anger management counseling and have no contact with the victim or family.
As a result of the new criminal offenses, Everett had his probation revoked. On a charge of simple assault he was resentenced to serve three months to two years in the Western Diagnostic Classification Center concurrent to all charges.
• Dexter I. McLaughlin, 40, 214 E. Locust St., Curwensville, was ordered to serve six months to one year in the Western Diagnostic Classification Center on a charge of possession of a controlled substance, specifically cocaine, to be served consecutive and aggregated to all charges being served.
• Jason L. Duey, 32, 917 Penn St., Harrisburg, was ordered to serve 60 days to one year in CCJ in addition to one-year consecutive probation on charges of possession of drug paraphernalia. He was fined $300 and is to attend drug and alcohol counseling.
• Gary Anderson, 40, CCJ, was ordered to serve 10 days to one year in Western Diagnostic Classification Center on a charge of possession of drug paraphernalia and possession of marijuana. He was fined $1 on each charge, is to refrain from the use and possession of alcohol and controlled substances and attend counseling as recommended by his probation officer.
As a result of the new criminal offense, Anderson had his probation violated. On a charge of simple assault, he was resentenced to serve 60 days to one year in CCJ.
• Zachery D. Ball, 22, 730 Patterson Ave., DuBois, was ordered to serve 30 days to six months in CCJ on a charge of DUI. He was fined $750, is to refrain from the use and possession of alcohol and controlled substances, not enter bars or places that serve alcohol, complete the DUI School and a full drug and alcohol assessment, and immediately surrender his driver's license. On a summary offense of stop signs, he received a $35 fine.
On a second case of DUI, Ball was ordered to serve 90 days to one year in CCJ consecutive to the first DUI. He received a $1,500 fine and is to serve an additional two years' consecutive probation. On a summary offense of careless driving, he received a $35 fine.
• Matthew J. Harris, 24, 2707 Carson Hill Road, DuBois, was ordered to serve 90 days to one year in CCJ in addition to two years' consecutive probation on terroristic threats, possession of drug paraphernalia and disorderly conduct. He was fined $375, is to refrain from the use and possession of alcohol and controlled substances, not enter bars or places that serve alcohol, attend anger management counseling, not enter East Side Sports Bar, complete 75 hours of community service, not own or possess narcotics or prescriptions for narcotics without first receiving written permission from his probation officer and pay restitution.
• Merrill J. Lonjin, 51, CCJ, was ordered to serve four months to one year in CCJ on a charge of DUI in addition to one-year consecutive probation. He received a $500 fine, is to refrain from the use and possession of alcohol and controlled substances, not enter bars or places that serve alcohol, complete a full drug and alcohol assessment, immediately surrender his driver's license and comply with ACT 63. On a summary offense of driving under suspension (DUI related), he received a $1,000 fine and is to serve an additional 90 days in CCJ. On summary offenses of driving on right side of roadway and driving on roadways laned for traffic, he received a $35 fine on each charge.
• Kenneth V. Smeal, 42, 823 Graham Road, Woodland, withdrew his guilty plea on a charge of delivery of a controlled substance. He will be placed on the trial list for further disposition. On a separate case, the court found him in violation of probation and ordered him to serve six months to three years in the Western Diagnostic Classifica-tion Center on a charge of delivery of a controlled substance, specifically Oxycodone.
• Derek M. Young, 28, 5161 Rockton Road, DuBois, was ordered to serve four months to one year in CCJ in addition to one-year consecutive probation on a charge of simple assault. He received a $200 fine, is to refrain from the use and possession of alcohol and controlled substances, not enter bars or places that serve alcohol, complete anger management counseling and pay restitution. On a summary offense of harassment, he received a $50 fine.
• April E. Kackison, 19, 350 S. 13th St., Reynoldsville, was placed on two years' probation on a charge of simple assault. She received a $300 fine, is to refrain from the use and possession of alcohol and controlled substances, not enter bars or places that serve alcohol, complete anger management counseling and not enter Walmart in Sandy Township. On a summary offense of retail theft, she received a $35 fine.
The following cases were continued:
• Heather Ellinger, 33, 5091 Panic-Wishaw Road, Reynoldsville, charged with DUI.
• Benjamin M. Marcus, 27, 438 Valley View Drive, Monroeville, charged with theft by deception.
• Patrick M. Dacillo, 23, Ramey, charged with two separate cases of theft by unlawful taking and burglary.
• Wendy L. English, 32, 507 S. Fourth St., Clearfield, charged with fraud to obtain food stamps.
• Anthony W. Thomas, 62, 312 E. Pine St., Clearfield, charged with DUI.
• Michael J. Lamb, 37, 987 Old Route 322, Philipsburg, withdrew his plea of guilty and will be placed on the trial list for further prosecution. He is charged with criminal solicitation/burglary.
• A bench warrant was issued for Jamie L. McClellan, 32, 4366 Philipsburg-Bigler Highway, West Decatur, for failing to appear for court. He is charged with six cases of burglary.
