Gun theft and drug charges heard at hearings
Thursday, June 11, 2009
By Liza Matia Staff Writer
Two Philipsburg men charged with stealing guns and selling them for drugs waived their rights to preliminary hearings yesterday at centralized court.

Richard Buchanan and Michael Phillips face charges of burglary, criminal conspiracy, criminal trespass, theft by unlawful taking and receiving stolen property.

According to the criminal complaint, three West Decatur residents reported April 3 that several guns, a flat-screen television, a laptop computer, and a bottle of prescription medication were stolen from their home. The weapons include a Sig 556 assault rifle, an AK 47 assault rifle, a Mossberg 12-gauge pump shotgun and a Bermington small arms seven-millimeter bolt-action rifle.

On April 9, a man told police that Mr. Phillips had texted him to ask if he knew anyone who wanted to buy guns. Mr. Phillips offered to sell a 12-gauge shotgun and a seven-millimeter rifle for $200. The man suspected the guns were stolen. In two texts that followed, Mr. Phillips offered to sell the guns for $120 and then $100.

Another man also told police that Mr. Phillips contacted him about selling the guns. Mr. Phillips took two of the stolen firearms to the man's house, where he sold them for $120. When the man later learned of the burglary, he contacted police and the guns were placed into evidence. The victim later identified them as his.

When Mr. Phillips was interviewed by police on April 17, he admitted that he drove himself and Mr. Buchanan to the West Decatur residence for the purpose of stealing the weapons. He dropped off Mr. Buchanan at the residence and then turned the vehicle around. He told police that he parked the car and Mr. Buchanan exited the residence carrying the firearms. The two loaded the guns into the backseat, then returned to the residence where Mr. Phillips stole the television and Mr. Buchanan removed the laptop computer.

The two then took the stolen items to Philadelphia where they sold two guns, a television, and a laptop for heroin. Mr. Phillips told police that the pair received eight bundles of heroin in the exchange.

Mr. Phillips is currently housed in Clearfield County Jail. Mr. Buchanan is free on $7,500 unsecured bail.

A Clearfield woman facing drug charges had her preliminary hearing continued for two weeks. Jessica Shomo, 26, is charged with manufacture/ delivery/possession with intent to manufacture or deliver a controlled substance and intentional possession of a controlled substance by a person not registered.

According to the criminal complaint, Ms. Shomo arranged to sell cocaine to a confidential informant in May 2008.

The confidential informant went to Ms. Shomo's residence with undercover officers and were met by the defendant walking down the road.

They continued to Edgewood Apartments in Hyde, where Ms. Shomo was to meet with someone who would obtain  the  drugs.

The undercover officer paid Ms. Shomo $300. She entered the apartment complex and returned with approximately 1.6 grams of cocaine.

The confidential informant later told police that Ms. Shomo had taken a gram of the cocaine for herself.

In another incident that happened last May, Ms. Shomo contacted undercover officers and reported that she had 10 grams of cocaine to sell for $950.

The officer went to the Shomo residence where he was to meet with a man who was bringing the drugs. When the man arrived, the officer gave Ms. Shomo the $950 and the two walked outside where the transaction was to take place.

Ms. Shomo entered the man's vehicle and returned with a baggie of suspected cocaine.

The drugs were placed into evidence at the state police barracks.

Ms. Shomo's preliminary hearing is scheduled for June 24.
