PUBLIC NOTICE

Pursuant to the Pennsylvania Clean Streams Law, the Pennsylvania Department of Environmental Protection Rules and Regulations, the Surface Mining Conservation and Reclamation Act, and the Coal Refuse Disposal Control Act as amended, notice is hereby given that Rosebud Mining Company, doing business at 301 Market Street, Kittanning, PA 16201, has made application to the Pennsylvania Department of Environmental Protection to add 35.3 acres to its current Lady Jane Plant permit CRDA# 17743702 and the related NPDES permit PA0215490 to allow for additional coal refuse disposal acreage to the current permit.

The proposed project will add approximately 35.3 additional acres on the current permit area in Huston Township, Clearfield County. This would include 11.9 acres of refuse disposal and 23.4 acres of support area. The boundaries of the additional permit limit are as follows: Starting at a point located 2,630 feet east of where Moose Grade Road intersects with SR-0153 just east of the town Penfield the permit limit expansion the permit limit then travels 2,370 feet north where it intersects with the existing permit. The permit limit then follows the existing permit south 1120 feet then east 380 feet then south approximately 1200 feet to the point described above. An additional 3 areas are also included in this expansion the first area located 3,770 feet northeast of the intersection of Moose Grade Road and SR-156 and consists of an area that is 150’ by 350 feet along the existing access road within the existing permit area. The second area is located approximately 4,370 feet north east of the intersection of Moose Grade Road and SR-156 and consists of an area of 2.3 acres along the northern boundary of the existing permit area. The final area is located along the eastern edge of the existing permit area and is located approximately 4,000 feet east of the intersection of Moose Grade Road and SR-156, the area contains approximately 10.4 acres and is approximately a 200 foot wide area along the eastern edge of the existing permit. The proposed areas can be found on the Penfield, PA U.S.G.S., 7 ½ minute series topographic map.

A copy of the application is available for public inspection, and copying for a fee, by appointment only at the Clearfield County Conservation District, 6395 Clearfield Woodland Highway, Suite 2, Clearfield, PA 16830. Written comments, objections, or a request for an informal conference may be submitted to the Department of Environmental Protection, District Mining Operations, 25 Technology Drive, California Technology Park, Coal Center, PA 15423, no later than thirty (30) days following the final publication date of this notice.
